Diminished value claims in California

By the Reclaim research team · Last updated · Legal review pending

In California, a claim against the at-fault driver can include the loss in value that remains after repair, under the state's civil jury instruction CACI 3903J. Your own policy generally does not pay it after a proper repair, and a lawsuit over car damage must be filed within three years.

Claims against the at-fault driver

California's civil jury instruction on damage to personal property, CACI 3903J, includes an optional paragraph for property that can be repaired but will be worth less afterward. In that case, damages are the drop in value after repair plus the reasonable cost of repair, capped at the property's value before the harm.

The owner has to show the car is worth less after repair. The instruction applies when the evidence supports it.

Claims under your own policy

In Ray v. Farmers Insurance Exchange (1988), a California appeals court held that an insurer that elects to repair the car under a collision policy does not also have to pay for the car's lost market value. The court declined to rewrite an unambiguous limit on collision coverage.

Later California decisions have followed that approach where the repair returns the car to its pre-accident safe, mechanical, and cosmetic condition. The wording of your own policy controls.

Filing deadline

California gives three years to file an action for injuring goods or chattels, which covers damage to a car (Cal. Code Civ. Proc. 338(c)(1)).

That is the deadline for filing suit. Talking with an insurer does not by itself extend it. A California attorney can confirm how it applies to your dates.

How diminished value claims tend to go in California

The California Department of Insurance summarizes the claim-handling time limits in its Fair Claims Settlement Practices Regulations, including responding to communications within 15 days and accepting or denying a claim within 40 days of proof of claim.

Many insurers answer a diminished value request with a formula rather than a market study. The best known is the 17c formula, which came out of the Georgia class actions over first-party claims that followed State Farm v. Mabry; its name comes from paragraph 17(c) of an injunction in one of them. It starts from a capped share of the car's value before the crash, then reduces it with damage and mileage modifiers. A law-firm survey notes it was built for that class action and has not been formally adopted for general use.

Adjusters commonly ask for proof that the repaired car is worth less, not only proof that it was damaged. Records that tend to matter: the final repair invoice and photos, the estimate showing any structural or frame work, the vehicle history report entry, and written market evidence such as dealer quotes or listings for the same car with and without an accident history.

Lost value is easiest to show once repairs are finished, because the value after repair is what gets compared with the value before the crash.

Questions

Can you claim diminished value in California?
Against the at-fault driver, California's jury instruction CACI 3903J allows the drop in value after repair plus repair cost, capped at the car's value before the harm. Under your own collision coverage, Ray v. Farmers (1988) generally limits the insurer to the repair.
How long do I have in California?
Three years to file a lawsuit for damage to a car, under Cal. Code Civ. Proc. 338(c)(1).
Who has to prove the lost value?
The owner. The jury instruction applies when the evidence shows the repaired car is worth less than it was before the crash.
Does Reclaim handle the claim for me?
No. Reclaim does not contact your insurer or act for you. This page is general information, not legal advice, and you stay in charge of your claim.

Check your California diminished value for free

If you kept the car after repairs and the other driver's insurer is handling the claim, the free check gives you an objective figure. It is not a recovery target.

  • Who was at fault, and whether the repairs are finished.
  • Roughly what the car was worth and what the repairs cost.
  • Then your name and number, and the repair invoice.
